Terms of Service

These Terms of Service (the "Terms") are a legally binding agreement between you and Infinique governing your use of the service at infinique.org(the "Service"). Please read them carefully. If you do not agree, do not use the Service.
1. Who we are and acceptance
Infinique is a software company registered in the United States (infinique.org). "We," "us," and "our" mean Infinique as operator of the Service. By creating an account or otherwise using the Service, you accept these Terms and our Privacy Policy.
2. What the Service does
Infinique is an AI caption optimisation and content publishing platform. It lets you:
- connect TikTok accounts through TikTok's official OAuth 2.0 flow;
- generate AI-optimised caption variations for engagement, SEO, and tone;
- publish photo slideshows to TikTok through the official Content Posting API;
- send content to a creator's TikTok inbox as a draft; and
- manage multiple TikTok accounts from one dashboard.
3. Eligibility
You must be at least 18 years old and able to form a binding contract. If you use the Service for an organisation, you represent that you are authorised to bind that organisation, and "you" refers to both.
4. Your account
You are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate registration information and keep it current. Tell us promptly at hello@infinique.org if you suspect unauthorised access.
5. Connected TikTok accounts
You may only connect TikTok accounts you own or are authorised to manage. You are responsible for having permission from the account owner, and for ensuring your use complies with TikTok's Terms of Service, Community Guidelines, and any applicable branded content or music policies.
We publish only what you confirm on the preview screen. You can disconnect an account at any time from the dashboard or from the TikTok app.
6. Your content
You keep all ownership of the images and captions you upload ("Your Content"). You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, and transmit Your Content solely to operate the Service on your instructions — principally to deliver it to TikTok when you confirm a post. This licence ends when you delete the content or your account, except for content already published to TikTok, which is governed by TikTok's terms.
You represent that you own or have the rights to Your Content, and that it does not infringe anyone's intellectual property, privacy, or other rights.
7. AI-generated suggestions
Caption suggestions are produced by a third-party AI model (Google Gemini) and are provided as drafts. They may be inaccurate, generic, or unsuitable. You are responsible for reviewing and editing any suggestion before publishing it, and you remain solely responsible for what you post. We make no guarantee about engagement, reach, or performance.
8. Acceptable use
You agree not to:
- post content that is unlawful, deceptive, harassing, hateful, or infringing;
- use the Service to spam, artificially inflate engagement, or coordinate inauthentic behaviour;
- connect accounts you are not authorised to manage;
- circumvent rate limits, security controls, or access restrictions;
- reverse engineer, scrape, or resell the Service without our written permission;
- interfere with the Service's operation or the experience of other users; or
- use the Service in violation of TikTok's terms or any applicable law.
Breach of this section may result in immediate suspension or termination.
9. Third-party services
The Service depends on third parties including TikTok, Google, Supabase, and Vercel. We do not control them. Their availability, behaviour, API limits, and policies may change without notice, which may affect or interrupt the Service. Your use of TikTok is governed by TikTok's own terms.
10. Plans, billing, and cancellation
Paid plans are billed in advance on a recurring basis until cancelled. Fees are stated on our pricing pageand are exclusive of taxes, which you are responsible for. We may change pricing with at least 30 days' notice before it applies to your next billing period.
You may cancel at any time; access continues until the end of the paid period. Except where required by law, payments are non-refundable. Failure to pay may result in suspension.
11. Service availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, and will give reasonable notice of material changes where practical. Maintenance may occur without notice.
12. Intellectual property
The Service, including its software, design, and branding, is owned by Infinique and protected by intellectual property laws. These Terms grant you a limited, revocable, non-transferable right to use the Service, and nothing more. You may not use our name or logo without written permission.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your use creates risk for us or other users. On termination your right to use the Service ends immediately; sections that by their nature should survive (ownership, disclaimers, limitation of liability, indemnity, governing law) will survive.
14. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted, or that any post will publish successfully, since publication depends on TikTok.
15. Limitation of liability
To the maximum extent permitted by law, Infinique will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising out of or relating to the Service.
Our total aggregate liability arising out of or relating to these Terms will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow these limitations, so they may not fully apply to you.
16. Indemnity
You agree to indemnify and hold harmless Infinique and its officers, employees, and agents from any claims, damages, liabilities, and reasonable legal fees arising from Your Content, your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
17. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. You and Infinique agree to try in good faith to resolve any dispute informally by contacting hello@infinique.org first. If that fails, disputes will be resolved in the state or federal courts located in Delaware, and both parties consent to that jurisdiction. Nothing here prevents either party from seeking injunctive relief where appropriate.
18. Changes to these Terms
We may update these Terms. The "last updated" date reflects the current version, and we will give notice of material changes by email or in-app notice before they take effect. Continuing to use the Service afterwards means you accept the revised Terms.
19. General
These Terms and the Privacy Policy are the entire agreement between you and Infinique regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
